Who provides Heist
Heist Inc. operates Heist. In these Terms, “Heist,” “we,” “us,” and “our” refer to Heist Inc. These Terms govern your use of the Heist app on iOS, Android, and the web, of useheist.com, and of the early-access waitlist and related communications.
Accepting these Terms
By using the app or website, creating an account, or joining early access, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use Heist.
Eligibility
You must be at least 18 years old and legally able to agree to these Terms. You may not use Heist where doing so would violate applicable law, and Heist may not be available in every country or region. You are responsible for complying with the laws that apply to you, including tax obligations arising from your trading.
Your account and wallets
Signing up creates a Heist account and embedded blockchain wallets operated with our infrastructure provider. Heist never asks for, holds, or stores your private keys or recovery phrases, and we cannot recover funds sent to a wrong address or network. You are responsible for maintaining control of the email address, phone number, or Apple account you sign in with, and for everything that happens under your account.
Trading, deposits, and withdrawals
Heist lets you fund a USDC balance and buy or sell supported digital assets across supported networks. Orders execute through third-party venues and public blockchain networks; execution, pricing, and availability are not guaranteed. Quotes are estimates: the final result of a trade depends on market conditions at execution, including slippage, liquidity, and network conditions. Heist charges fees on trades, which are shown before you confirm. Blockchain transactions are irreversible once broadcast: we cannot cancel, reverse, or refund them.
Assumption of risk
Digital assets — memecoins in particular — involve substantial risk, including extreme volatility, thin or vanishing liquidity, manipulation, smart-contract defects, and total loss of principal. A token that can be bought may become impossible to sell. You alone decide what to trade, and you should not trade money you cannot afford to lose.
Information only — not financial advice
Heist content — including signals, checks, verdicts, summaries, and AI-generated analysis — is provided for general informational and research purposes. It is not investment, financial, legal, tax, accounting, or other professional advice; a recommendation or solicitation; or a guarantee of safety, liquidity, price, performance, access, or outcome. AI analysis, market data, estimates, and interpretations may be delayed, incomplete, unavailable, or wrong. You are responsible for your own research and decisions and should consult qualified advisers where appropriate.
Early-access communications
When you join the waitlist, you ask us to send confirmation, product, and access updates to the email address you provide. You represent that you control that address. You may unsubscribe at any time using the link in an email. Unsubscribing from optional updates may not prevent essential messages about an access program you later join.
Acceptable use
You agree not to:
- Use Heist unlawfully, fraudulently, or to harm another person, including for money laundering, sanctions evasion, or market manipulation.
- Create an account with credentials you do not control, or impersonate another person or entity.
- Interfere with the service, bypass rate limits or security controls, introduce malicious code, or attempt unauthorized access.
- Scrape, copy, or reverse engineer the service in a way that violates law or materially burdens it.
- Misrepresent Heist content as a guarantee, endorsement, or individualized recommendation.
Ownership
The app, website, Heist branding, design, text, graphics, software, and other content are owned by Heist Inc. or its licensors and are protected by applicable intellectual-property laws. These Terms do not grant you ownership or permission to use Heist names, marks, or content except as needed for ordinary personal use of the service.
Third-party services and links
Heist relies on and may link to third-party services, blockchain networks, trading venues, data sources, and websites. We do not control them and are not responsible for their content, availability, security, or practices. Your use of third-party services is governed by their terms and policies.
Disclaimer of warranties
To the maximum extent permitted by law, the app, website, waitlist, and all content are provided “as is” and “as available.” Heist Inc. disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Heist Inc. and its directors, officers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, data, opportunities, or goodwill; trading or investment losses; losses caused by blockchain networks, trading venues, or other third parties; or losses arising from reliance on content, even if advised that such losses were possible.
Where liability cannot be excluded, Heist Inc.’s aggregate liability arising from the service will not exceed the greater of US$100 or the fees you paid Heist Inc. for the affected service during the 12 months before the claim. Nothing in these Terms excludes liability that cannot lawfully be limited.
Suspension, changes, and account closure
We may change, suspend, restrict, or discontinue any part of Heist at any time. We may restrict or close an account when reasonably necessary for security, legal compliance, abuse prevention, or protection of Heist or others. You can close your account at any time from Privacy & account in the app; closing your account does not erase records we must keep by law or transactions already recorded on public blockchains.
Changes to these Terms
We may update these Terms as Heist changes. We will post the revised Terms here and update the date above. Your continued use after revised Terms take effect means you accept them, except where law requires another form of notice or consent.
General
If a provision of these Terms is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets. Applicable law and courts with lawful jurisdiction will govern disputes unless mandatory law requires otherwise.
